IP POLICY
(Also known as ‘The Stuff I Really Shouldn’t Have to Say Because Didn’t You All Learn Stealing is Wrong in Kindergarten or Sunday School???’)
Jennifer Cvelbar writing either under her legal name or her pseudonym, Jennifer A. Davids, (herein known as ‘the author’) reserves exclusive rights to her collective creative and written content* (herein known as ‘the author’s work’). This encompasses the rights to the following: reproduction, distribution, adaptive or derivative work, digital publication, audiobook production and translation, merchandising and licensing, and the use of generative AI. (Hi, I’m Jen. This is my stuff and why you can’t/shouldn’t steal it.)
Reproduction: The reproduction of the author’s work is expressly prohibited except under the terms of the Fair Use Doctrine. (In other words, don’t plagiarize me.)
Distribution: Distribution of the author’s work is prohibited except in the case of the author’s discretion, by those entities to which the author gives permission, and/or with which the author is already in agreement, i.e. Amazon and other like publishers. (Unless you’re Amazon, B&N, and/or another bookstore or me, you can’t sell my work for your own profit. I mean you can sell a used copy at your garage sale. But don’t buy a truckload of brand-new copies, sell them, and then keep all the money. That’s not cool. And it’s just mean.)
Adaptive or Derivative Work: Adaptive or Derivative work is ONLY permissible in the form of fan art (visual or written), must not include a substantial portion of the author’s work, and must be non-commercial in nature i.e. no money can be made from such work either directly or indirectly. Use of the work in social media posts promoting and/or reviewing the work is permissible so long as the author’s generative AI policy (See ‘Generative AI’ below – it’s in bold type, you can’t miss it) is followed. (Fan art is fine between you and your besties but please keep it that way. I love the Bookstagramer and BookTok communities and my fellow authors but let’s respect each other’s rights and boundaries.)
Digital Publication: Digital publication of the author’s work is prohibited except by the author herself, by those entities to which the author gives permission, and/or with which the author is already in agreement, i.e. Amazon and other like publishers. (Pretty much the same as that bit at the end of ‘Distribution’.)
Audiobook Production and Translation: Audiobook production, and translations of the work in all forms is at the sole discretion of the author. The only exception is in the case of A Perfect Weakness where a previous agreement to audiobook production is already in existence. (Just because my books don’t have audiobooks or other translations (yet) doesn’t mean you get to DIY it. Except A Perfect Weakness. There’s already an audiobook for that. So don’t DIY that either. But your library might have it. You should check.)
Merchandising and Licensing: The author retains sole rights to both merchandising and licensing. The commercial use of the author’s work is prohibited. (Don’t sell earrings of my book covers on Etsy, OK?)
Generative AI: AI generated images, AI generated films, AI generated reels, AI generated shorts, or AI generated videos of or including the author’s work be it commercial use, non-commercial use, and/or social media posts are strictly and utterly prohibited without exception. Inputting the author’s work into an AI model of any type or form is strictly and utterly prohibited without exception. Use of the author’s work to train generative AI is strictly and utterly prohibited without exception. This also includes images on this website or on social media of the author herself. (Don’t dehumanize or degrade me or my work by putting me or it through AI. Period. Don’t ask for an exception – the answer will always be ‘no’.)
Special Note: The use of assistive AI such as background eraser, spell check, use of a template, and/or other similar AI tools in the creation of social media posts is permissible. (Yes, you can use Canva.)
*PLEASE NOTE: ‘creative and written content’ includes the following: book covers (created by the author), back cover copy (written by the author), the author’s written bio, and original social media reels, videos, or posts directly related to the author’s works. (So like all the stuff I create. All of it.)
